Agreement to Terms
These Terms of Service ("Terms") govern your use of the My TallyBook mobile application ("App") operated by JAZ 12-16 LLC ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.
If you do not agree to these Terms, do not download, install, or use the App.
Use of the App
My TallyBook is a digital tally book application designed for recording field measurements and tally data in oilfield operations. You may use the App for its intended purpose in accordance with these Terms.
Eligibility: You must be at least 13 years old to use the App. If you are under 18, you must have parental or guardian consent.
Account: You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
Accuracy: You are responsible for the accuracy of the data you enter into the App. My TallyBook is a recording tool and does not independently verify field measurements.
Subscription & Payment
The App offers a free 30-day trial with full access to all features. After the trial period, continued access to premium features requires a paid subscription.
- • Subscriptions are billed monthly through the Apple App Store or Google Play Store.
- • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
- • You can manage and cancel your subscription through your App Store or Google Play account settings.
- • Refunds are handled according to the policies of the Apple App Store or Google Play Store.
Intellectual Property
The App and its original content, features, and functionality are owned by JAZ 12-16 LLC and are protected by international copyright, trademark, and other intellectual property laws.
You retain ownership of the data you enter into the App. By using the App, you grant us a limited license to store, process, and display your data as necessary to provide the App's services.
Limitation of Liability
My TallyBook is a recording and organizational tool. It is not a substitute for professional engineering judgment, safety verification, or regulatory compliance. You acknowledge that:
- • The App is provided "as is" without warranties of any kind.
- • We are not liable for any errors in data entry or calculations resulting from user input.
- • We are not liable for any damages arising from the use or inability to use the App.
- • Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.
Termination
We may terminate or suspend your account and access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes through the App or by other means. Your continued use of the App after changes constitutes acceptance of the modified Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
